The coverage, convenience, and cost-effectiveness of the Madrid System make it the preferred choice of many enterprises looking to go global. How can you use the Madrid System to seek cross-border protection of your brands? Let’s take a closer look at the preparation and processing of an international trademark registration, and the documentation you need to provide.
第一步：自查是否具备资格
Step1: Check if you are eligible
要使用马德里体系，您必须已经持有国内商标，或已经通过中国国家知识产权局（CNIPA）提交国内商标注册申请。
To use the Madrid System, you must already have – or have applied for – a national trademark registration through the China National Intellectual Property Administration (CNIPA).
您还必须是中国公民，或在中国有真实有效的企业或住所。
You must also be a Chinese national, or have a real and effective business or domicile in China.
第二步：准备所有证明文件
Step2: Prepare all supporting documents
您必须提供：
• 以中文撰写的马德里商标国际注册申请书；
• 以英文或法文撰写的商标国际注册申请书（马德里体系MM2表格）；
• 加盖公章或签字的注册人证明文件，如营业执照、居住证明、身份证件等文件的复印件；
• 授权委托书（如果您希望委托一名商标代理人管理您的商标国际注册）；
• 马德里体系的可下载表格MM18（如果您希望指定美利坚合众国）
You must provide:
· Application for an international trademark registration through the Madrid System in Chinese;
· Completed application for an international trademark registration in English or French (Madrid System Form MM2);
· Credential documents with an official seal or signature, such as copies of the business license, proof of residence, or identity documents;
· Power of attorney (if you wish to appoint a trademark representative to manage your international trademark registration);
· Madrid System downloadable form MM18 (if you wish to designate the United States of America).

Step3: Prepare and submit your application
您可以通过中国商标网直接在线提交商标国际注册申请（https://sbj.cnipa.gov.cn/sbj/wssq/），也可以向中国国家知识产权局商标局提交纸质申请。
You can submit your application for an international trademark registration directly online through https://sbj.cnipa.gov.cn/sbj/wssq/ or submit paper application through the Trademark Office of CNIPA.
*提示：马德里体系是用于实施全球商标保护战略的国际注册体系。您应该：
1. 仔细考虑您的商标跨境保护战略，特别是您的目标市场以及您希望涵盖和/或优先考虑的商品和服务。

*Tips: The Madrid System is an international registration system used to implement a global trademark protection strategy. You should:
1. Think carefully about your cross-border trademark protection strategy, in particular the markets you wish to target and the goods and services you wish to cover and/or prioritize.
2. Have a good command of English or French. The official languages of the Madrid System are English, French and Spanish. You can complete your application through CNIPA in English or French. Note: Much of the supporting documentation provided by the Madrid System is available in Chinese.
3. Be aware of the relevant trademark laws and legal requirements of the countries in which you seek protection.
4. You may wish to appoint a trademark professional to manage your international trademark registration under the Madrid System.

If you choose to appoint a trademark representative, then they will guide you through these steps. If you decide to submit the application yourself you should:

1. Search for trademarks in your target markets: Make sure that your mark is not the same as – or similar to – other trademarks in your target markets before you file your application. If the name, logo, or design of your trademark is identical or similar to a registered or pending trademark, then protection will likely be refused in that jurisdiction. You can use WIPO’s Global Brand Database available under eMadrid to search trademarks in multiple national, regional and international collections. You can further optimize your application strategy based on the search results.
2. 支付费用：商标国际注册费用将取决于您选择的市场数量和商品或服务类别。费用包括基础注册费、补充注册费、附加注册费和单独规费。所有费用均以单一货币（瑞士法郎）支付。
2. Pay fees: The cost of your international trademark registration will depend on the number of markets and classes of goods or services you choose. Fees include a basic registration fee, a complementary registration fee, a supplementary registration fee and individual fees. All payments are made in one currency – Swiss Francs.

*Tip:You can estimate the cost of an international trademark registration using the Fee Calculator under eMadrid on WIPO’s website.
中国申请人可以用人民币向中国国家知识产权局缴纳注册费。该局随后会将注册费以瑞士法郎转帐给产权组织。
Applicants in China can pay registration fees in Renminbi (CNY) to the CNIPA. The CNIPA will then transfer the registration fees to WIPO in Swiss francs.
第四步：形式审查和实质审查
Step4: Formal and substantive examination
一旦您提交了商标国际申请，中国国家知识产权局将审核其中的细节是否与您的国内商标注册一致。他们将验证该申请，并将其转送给产权组织。
Once you submit your international trademark application, the CNIPA will check that the details included correspond to your national trademark registration. They will certify the application and forward it to WIPO.

WIPO carries out formal examination, checking that the application complies with the format and requirements of the Madrid System.

WIPO notifies all the Madrid System Members where you seek protection of your mark (your target markets). The IP Office of each of those Members then performs substantive examination, in accordance with their local laws and regulations.

Step5: Granting or refusal of protection
各知识产权局将做出是否授予商标保护的决定。如果决定授予保护，它们将通知产权组织，产权组织再通知您。
Each IP Office will decide whether to grant you protection. If yes, they will inform WIPO, who in turn will notify you.
如果保护被临时驳回，产权组织将向您转发知识产权局发出的通知。通知将包括驳回理由、需要采取的任何进一步措施（包括答复时限）、复审或上诉选项，以及您是否需要指定当地代理人协助。
If protection is provisionally refused, WIPO will forward you the notifications issued by the IP Office(s). The notification will include the reasons for the refusal, any further steps that are required (including the time limit to respond), review or appeal options, and whether or not you need to appoint a local agent to assist you.
各局必须在规定时限内授予或拒绝保护——自我们将其指定通知主管局之日起12个月，或在某些情况下，18个月。
Each Office must grant or refuse protection within a given time limit – 12, or in some cases 18 months from the date on which we notified the Office of its designation.

If no refusal notification is received from a given IP Office within this time limit, then your trademark is automatically protected in that jurisdiction.
